I hereby irrevocably authorize Forest Lake Nature School to edit, alter, copy, exhibit, publish, or distribute any photo or video footage of myself and/or my child(ren) for the purpose of publicizing Forest Lake Nature School’s programs or for any other lawful and related purpose.
I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness or my child(ren)’s likeness appears. I further waive any right to royalties or other compensation arising from or related to the use of such photographs or video footage.
I hereby hold harmless, release, and forever discharge Forest Lake Nature School, its directors, staff, volunteers, and affiliates from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate may have by reason of this authorization.
In exchange for participation in classes and activities organized by Forest Lake Nature School, and/or the use of property, facilities, and services provided, I agree for myself and, if applicable, for my family members, to the following:
I agree to observe and obey all posted rules and guidelines, and further agree to follow any oral instructions or directions given by Forest Lake Nature School staff, representatives, or volunteers.
I recognize that there are inherent risks associated with outdoor and nature-based activities. I assume full responsibility for personal injury to myself and, if applicable, my family members, and further release and discharge Forest Lake Nature School, its staff, volunteers, land partners, and representatives from liability for injury, loss, or damage arising out of participation or presence, whether caused by myself, my family, Forest Lake Nature School, or other third parties.
I agree to indemnify and defend Forest Lake Nature School against all claims, causes of action, damages, judgments, costs, or expenses (including attorney fees and litigation costs) that may arise from my or my family’s participation or presence in school programs.
I agree to be responsible for the cost of any damages to the facilities or property of Forest Lake Nature School caused by negligent, reckless, or willful actions by me or my family.
In the event of injury to the below minor(s) during program activities, I give permission to Forest Lake Nature School staff or representatives to arrange for necessary medical treatment, for which I shall be financially responsible. Forest Lake Nature School shall have the authority to: a. Seek appropriate medical treatment, including care from a licensed physician and/or hospital. b. Authorize medical treatment or procedures in an emergency situation. c. Make appropriate decisions regarding clothing, nourishment, and shelter for the minor(s) in their care.
Any legal or equitable claim arising from participation in Forest Lake Nature School programs shall be resolved under the laws of the State of Minnesota.
I acknowledge that I am under no pressure or duress to sign this Agreement. I have had a reasonable opportunity to review its terms and may consult legal counsel if desired. I further acknowledge that Forest Lake Nature School has offered to refund any fees paid if I choose not to sign this Agreement.
This Agreement is the product of an arm’s length negotiation between the parties. In the event of ambiguity, no party shall be considered the “drafter” for purposes of interpretation.
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
I consent to the participation of my child(ren) in Forest Lake Nature School classes and activities, and agree on their behalf to all terms and conditions contained in this Agreement. By signing, I represent that I have legal authority over and custody of the minor(s) listed below.
